July 7, 1999 OUR FIRST CHAT OUT ON THE WEB - "LIGALITIES"

Hi everyone. Welcome to the new LIVE CHATS board. I, Dolores McCann, along with Earlene Moore, are your hosts. We will meet here every 1st Tuesday of each month (except August , it'll be the 3rd Tuesday since the 1st Tues. falls during our ICES convention). You are ALL welcome to meet here any day or time of day you ever want to. But on ALL Tuesday nights we will have a LIVE CHAT. Earlene or I may or may not be present. I changed the title of this chat to JUST 'Legalities' because I felt that PRICING would make it too complicated for our first chat. We will do PRICING next time...in August, for you. Bring along your current 20000 Yearbook to that chat! (Yearbook due here by the end of July...order now!).
 
 
 

LEGALITIES
I don't know of anything more important to be 'up' on than Legalities. But, until you get REALLY busy I don't think you should worry about this much at all. Just do your cakes, take classes and learn. Then maybe someday you WILL need licensees. But for starting out NO, I don't think so. I have thousands of customers in my retail store and only about 2-3 are legal....if this tells you anything!

Most of us do cakes from our home and can't be legal ever. I did for years. I know how you feel. Sometimes it is scary. But nothing bad ever happened at all. Finally, when I started doing up to 8 wedding cakes per week at home, I got licensed by our Ohio Department of Agriculture ($10.00 per year). They inspect you once a year and requirements are very lax. DO NOT expect it to be this way in highly metropolitan areas, such as on the East coast of the USA. The authorities are naturally more stringent where they must control the flow of  highly populated areas.

Requirements vary. But here I need the Dept. of Ag. License and the city health dept. license (I'm within city limits and wasn't at home). I could not have been licensed by Hamilton City to do cakes from my home if I'd lived in the city then. I wouldn't have even tried.

In some areas they also require some sort of business license. I have no idea how this works.

To find out the requirements, call your city or county health departments and ask for a copy of the requirements.

ZONING: Zoning is usually also a factor. Even in the county. If you are not zoned business, you can be shut down. Businesses are usually only located in zoned-business areas. You may be able to get a variance but this depends on your neighbors agreeing within so many feet of your property.

b.keith:      What is legal depends on where you are. Around here (Fairfax County VA), it means a business license and sales tax registration at a minimum.

Many times you can't do that at all anyway. It was very easy for me to get legal since I have a store front. But when you do anything at home,..  it can be SO difficult and such variations of the laws

DOLORES7:   The rest is from Earlene...she sent us earlier I guess the thing that bothers most of us most often is the legalities of the Copyrights law. Our customers who want cute birthday cakes for their kids want the same designs as is on the napkins or party favors or etc. That is where we can get in trouble. All of those designs are copyrighted and protected by law. We cannot legally use those designs on our cakes to  sell to our customers.  You can purchase any of the pre-made items such as images or plastic pieces and etc and add those to a cake for the customer. Because that manufacturer has paid a premium fee to be able to sell those products we do
have the accessibility to the plastics. Otherwise we would be totally up a creek. So just count your blessings that we do have those plastic figures we can

DOLORES7:   use for your customers cakes.  Even the Wilton shaped pans are made with a customer in mind who simply wants to do cakes for her children. We are not supposed to sell even those  designs. I know that doesn&sup1;t sound reasonable or make much sense to us who  have customers begging us to do those starred in cakes. But that is what we use for your customers cakes.

b.keith:      For allergies:      The big ones are nuts, dairy, chocolate. Rarer are wheat (gluten), and some others. Make sure to list those, and
you'll probably have most folks covered.
